II. Scope and Definitions

(1) These General Terms and Conditions apply to all products ordered by you through the website https://pettive.com/ and all legal transactions between you and PETRIVE Sp. z o.o. through this website, hereinafter referred to as the "PETRIVE Sp. z o.o. Online Store."

(2) Our PETRIVE Sp. z o.o. Online Store is intended solely for consumers.

(3) By placing an order in the PETRIVE Sp. z o.o. Online Store, you confirm that you are of legal age to enter into binding contracts under the laws of your country.

III. Purchase Agreement Conclusion

Ordering and Steps to Conclude a Purchase Agreement

(1) The presentation of products in the PETRIVE Sp. z o.o. Online Store does not constitute a binding offer from us to conclude a purchase agreement. It serves as an invitation for you to submit a binding purchase offer.

(2) Before placing your first order, you may register as a new customer. You can also register at a later time. Orders can also be placed without registration, as a guest.

Mandatory data that must be provided during the registration process or when placing an order must be truthful. If additional information is voluntarily provided, it must also be accurate.

(3) Clicking the "Add to Cart" button allows you to add selected items to a virtual shopping cart without creating any obligation. The contents of the shopping cart can be viewed by clicking the shopping cart button. You can change the number of items in the shopping cart and remove items.

(4) After clicking the "Proceed to Checkout" button, you will be asked to provide personal information and select a payment method and delivery option, unless you have already provided some of this information during registration. The order's content and order details will be displayed in a summary before submitting the purchase offer.

Please review the displayed summary carefully. If necessary, you can correct or change the provided information. You can also interrupt the order process at any time, for example, by clicking the "Return to Cart" button or clicking the PETRIVE Sp. z o.o. logo in the website's header.

(5) Clicking the "Buy Now" button means sending us your order and making a binding offer to conclude a sales contract for the items placed in the cart.

Acceptance, Confirmation of the Contract, and Other Agreement Requirements

(1) Upon accepting your order, we will promptly send you an email confirmation of your order's receipt, including order details (receipt confirmation). This confirmation of receipt does not yet constitute acceptance of the purchase offer.

(2) You will receive an email notification when the ordered items are shipped as soon as they are handed over to the shipping company (shipping confirmation). Unless explicitly indicated otherwise, the shipping confirmation also represents our binding acceptance of your purchase offer.

Information Regarding Your Right of Withdrawal

(1) Consumers have the following right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier (or from the day of possession of the last item in the case of a contract relating to several items ordered under a single order and delivered separately), take(s) possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the attached withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. The goods must be unused.

(2) Exclusion of the Right of Withdrawal:

The right of withdrawal may not apply to the following contracts, unless otherwise agreed by the parties:

Contracts for the delivery of goods that are not prefabricated and for their production, an individual choice, or determination by the consumer or are clearly tailored to the consumer's personal needs.

Contracts for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons once the seal is removed.

Additional Information

(1) We will store the contract content related to your orders, which you can access after completing the order process. You can also print order information after placing the order. After our confirmation of order receipt but no later than at the time of delivery of the goods, we will provide you with the contract content in text form (e.g., by email or printed copy).

(2) These General Terms and Conditions can be viewed, saved, and printed from the PETRIVE Sp. z o.o. Online Store at any time using the "Terms and Conditions" link.

(3) The contract will be concluded and executed in the Polish language.

IV. Execution of Purchase Agreement; Payment Execution; Delivery

Prices and Shipping Costs; Special Offers; Availability; Delivery Limitations

(1) The prices we provide include the legally required value-added tax applicable at the time of the order.

(2) We charge a flat-rate shipping cost depending on the chosen shipping method.

Shipping costs will be clearly specified again on the last page with product details (if necessary, via hyperlink).

(3) Please note that we can generally present special offers for a limited time only. Products displayed in the PETRIVE Sp. z o.o. Online Store may have different availability. Product availability may also depend on specifications (e.g., size or color). If a product is unavailable, this will be indicated in the product information.

If your order cannot be delivered due to product unavailability, we will notify you promptly in the order receipt confirmation or contact you (e.g., via an additional email message). If products are permanently unavailable, we will not be able to accept your order, and a contract will not be concluded in this case.

Payment Methods and Payment Deadlines

(1) Payment for the goods must be made using one of the payment methods listed below. However, we reserve the right not to make specific payment methods available in individual cases.

Credit Card: We accept American Express, VISA, and Mastercard cards.

PayPal: To make payments through the online PayPal payment service, you need to have a PayPal account. If you choose this payment method, you will be redirected to the PayPal website to make the payment. The amount will be charged at the time of shipping.

Apple Pay: Apple Pay is a payment method offered by Apple Inc. To use Apple Pay, you must activate the Apple Pay feature (e.g., on an iPhone), verify your identity by providing access data, and confirm the payment order. The amount will be charged at the time of shipping.

Gift Voucher: Gift vouchers and associated balances can only be redeemed before completing the order process. They cannot be used after the order process is completed. Gift voucher balances cannot be paid out in cash and are non-interest-bearing.

(2) Regardless of the chosen payment method, you will receive an invoice no later than with the delivery of the goods. If the invoice address differs from the delivery address, we will send the invoice by mail to the billing address or by email to the address you provided.

Delivery Time; Shipping and Transfer of Risk; Partial Deliveries; Delay

(1) The delivery times stated in the table available in the PETRIVE Sp. z o.o. Online Store apply to deliveries within Poland, and the running of the deadline begins upon our binding acceptance of your purchase offer.

Information on delivery times for deliveries to other countries is also provided in the table.

(2) Deliveries will be made to the delivery address you specify. Shipments will be made by an appropriate shipping company. The risk of accidental loss of the ordered goods passes to you upon delivery of the goods to you or your authorized representative or if you refuse to accept the goods.

(3) We are entitled to make partial deliveries if this is reasonable for you. In the case of partial deliveries, any additional shipping costs will be covered by us.

(4) In the event of a delay in payment on your part, we reserve the right to charge you statutory interest on arrears. We also reserve the right to seek compensation for any additional losses incurred as a result of such delay.

Retention of Title; Set-off and Right of Retention

(1) Goods remain our property until the entire amount stated on the invoice has been paid.

(2) The right of retention applies only to claims based on the same contractual relationship.

Your Rights in Case of Defects

We will deliver all goods free from defects. In the event of damaged goods or if they have any other defect (e.g., an incomplete delivery), you have the legal rights based on Polish law regarding our liability for defects ("warranty").

Liability and Limitation of Liability

(1) Without prejudice to legal regulations governing liability issues, we are not liable for any unlimited amount for damages arising from intentional or grossly negligent acts (including intentional or grossly negligent actions by our legal representatives or vicarious agents), or in the event of negligence or intentional harm to life, body, or health. This also applies to statutory liability, such as product liability regulations.

V. Miscellaneous Provisions

Procedure for Submitting Complaints

In case you are dissatisfied with our services or products, you have the right to file a complaint. A complaint can be filed with us by email, through the contact form, by phone, or in writing. Complaints can be submitted free of charge and do not affect your general right to pursue claims in court.

To expedite processing of your complaint, it is recommended to include your personal data (name, address, email address, contact phone number), order number, purchase location information, and an explanation of the reason for the complaint. Complaints concerning product defects should include photos of the relevant defects to the extent possible.

We will provide you with a response within 30 days in a durable medium (in writing or by email). If we do not provide a response within 30 days, the complaint will be deemed accepted.

Information on Alternative Dispute Resolution for Consumer Disputes

We are neither required nor willing to participate in dispute resolution proceedings before a consumer conciliation body.

Consumers have the right to use out-of-court dispute resolution and claim settlement methods.
