I. Contracting Party
Your contracting party for all legal transactions concluded with us and covered by these General Terms and Conditions is:

II. Scope and Definitions
(1) These General Terms and Conditions apply to all products ordered by you through the website https://petrive.com/ and to all legal transactions between you and PETRIVE Sp. z o.o. conducted through this website, hereinafter referred to as the “PETRIVE Sp. z o.o. Online Store.”
(2) Our PETRIVE Sp. z o.o. Online Store is intended exclusively for consumers.
(3) By placing an order in the PETRIVE Sp. z o.o. Online Store, you confirm that you are of legal age under the laws of your country and have the legal capacity to enter into binding agreements.
III. Conclusion of the Purchase Agreement
Ordering process and steps required to conclude the Purchase Agreement
(1) The presentation of products in the PETRIVE Sp. z o.o. Online Store does not constitute a binding offer by our company to conclude a purchase agreement. It is an invitation for you to submit a binding purchase offer.
(2) Before placing your first order, you may register as a new customer. You may also register at a later time. Orders may also be placed without registration, as a guest.
All mandatory information provided during the registration or ordering process must be true and accurate. Any additional information provided voluntarily must also be accurate.
(3) Clicking the “Add to Cart” button allows you to add selected items to your virtual shopping cart without obligation. The contents of the shopping cart can be displayed by clicking the shopping cart button. You may change the quantity of items in the cart and remove items.
(4) After clicking the “Proceed to Checkout” button, you will be asked to provide personal details and select a payment method and delivery option, unless you have already provided some of this information during registration. The contents and details of your order will be displayed in a summary before you submit your purchase offer.
Please carefully review the displayed summary. If necessary, you may correct or amend the information provided. You may also interrupt the ordering process at any time, for example by clicking the “Return to Cart” button or the PETRIVE Sp. z o.o. logo in the website header.
(5) Clicking the “Buy Now” button means that you submit your order to us and make a binding offer to conclude a purchase agreement concerning the items placed in the shopping cart.
(6) After receiving your order, we will immediately send you an e-mail confirmation containing the order details (order receipt confirmation). Confirmation of receipt of the order does not yet constitute acceptance of your purchase offer.
(7) You will receive an e-mail notification when the ordered items have been dispatched, as soon as they are handed over to the carrier (shipping confirmation). Unless expressly stated otherwise, the shipping confirmation also constitutes our binding acceptance of your purchase offer.
2. Information on the Right of Withdrawal
(1) Consumers have the right to withdraw from the agreement.

You have the right to withdraw from this agreement within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and designated by you, take possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the agreement by means of an unequivocal statement, for example by a letter sent by post, fax, e-mail or through the return form. You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this agreement, we will reimburse all payments received from you, including delivery costs, without undue delay and in any event no later than fourteen days from the day on which we were informed of your decision to withdraw from this agreement. We will make the reimbursement using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you informed us of your withdrawal from this agreement. The deadline is met if you send back the goods before the fourteen-day period has expired. You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3. Exclusion of the Right of Withdrawal:
The right of withdrawal does not apply to the following agreements unless the parties have agreed otherwise:
Agreements for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.
Agreements for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if they have been unsealed after delivery.

(1) We will store the content of the agreement relating to your orders, which you will be able to access after completing the ordering process. After placing the order, you will also be able to print the order information. Following our confirmation of receipt of the order, but no later than upon delivery of the goods, we will provide you with the content of the agreement in text form, for example by e-mail or in printed form.
(2) These General Terms and Conditions may be viewed, saved and printed at any time in the PETRIVE Sp. z o.o. Online Store via the “Terms and Conditions” link.
(3) The agreement shall be concluded and performed in Polish.
IV. Performance of the Purchase Agreement; Payment Processing; Delivery
Prices and Shipping Costs; Special Offers; Availability; Delivery Restrictions
(1) The prices quoted by us do not include statutory VAT pursuant to Article 113(1) and (9) of the Polish VAT Act, as applicable at the time the order is placed.
(2) We charge a fixed delivery fee depending on the selected delivery method.
Delivery costs will be clearly specified on the final product details page, if necessary by means of a hyperlink.
(3) Please note that special offers are generally available only for a limited period. Products presented in the PETRIVE Sp. z o.o. Online Store may have different levels of availability. Product availability may also depend on specifications such as size or colour. If a product is unavailable, this will be indicated in the product information.
If your order cannot be fulfilled due to lack of product availability, we will inform you without undue delay in the order receipt confirmation or contact you, for example by an additional e-mail. If the products are permanently unavailable, we will not be able to accept your order and no agreement will be concluded.
4. Payment Methods and Payment Deadlines
(1) Payment for the goods must be made using one of the payment methods listed below. However, we reserve the right not to offer certain payment methods in individual cases.
Credit card: We accept American Express, VISA and Mastercard.
PayPal: To make a payment via the PayPal online payment service, you must have a PayPal account. If you select this payment method, you will be redirected to the PayPal website to complete the payment. The amount will be charged at the time of dispatch.
Apple Pay: Apple Pay is a payment method offered by Apple Inc. To use Apple Pay, you must activate the Apple Pay function, for example on an iPhone, verify your identity by providing access credentials and confirm the payment order. The amount will be charged at the time of dispatch.

Gift voucher: Gift vouchers and their associated balance may only be used before the ordering process is completed. They cannot be applied after the ordering process has been completed. The balance of a gift voucher cannot be paid out in cash and does not bear interest.
(2) Regardless of the selected payment method, you will receive an invoice no later than upon delivery of the goods. If the billing address differs from the delivery address, we will send the invoice by post to the billing address or to the e-mail address provided by you.
Delivery Times; Dispatch and Transfer of Risk; Partial Deliveries; Delay
(1) The delivery times stated in the table available in the PETRIVE Sp. z o.o. Online Store apply to deliveries within Poland, and the delivery period begins upon our binding acceptance of your purchase offer.
Information regarding delivery times for deliveries to other countries is also provided in the table.
(2) Deliveries will be made to the delivery address provided. Shipments will be delivered by the relevant carrier. The risk of accidental loss of the ordered goods passes to you upon delivery of the goods to you or your authorised representative, or in the event of refusal to accept the goods.
(3) We are entitled to make partial deliveries where this is reasonable in your case. In the event of partial deliveries, any additional delivery costs will be borne by us.
(4) In the event of delayed payment on your part, we reserve the right to charge statutory interest for late payment. We also reserve the right to claim compensation for any additional losses incurred as a result of such delay.
Retention of Title; Set-off and Right of Retention
(1) The goods remain our property until the full amount specified on the invoice has been paid.
(2) A right of retention may only be exercised in relation to claims arising from the same contractual relationship.
Your Rights in the Event of Defects
We will deliver all goods free from defects. In the event of damaged goods or another defect, for example an incomplete delivery, you are entitled to the rights available under Polish law in relation to our liability for defects.
Liability and Limitation of Liability
(1) Without prejudice to the statutory provisions governing liability, our liability shall not be unlimited for damage resulting from intentional or grossly negligent acts, including intentional or grossly negligent acts of our legal representatives or authorised agents, or in the event of intentional or grossly negligent injury to life, body or health. This also applies to liability under product liability regulations.
V. Miscellaneous Provisions
Complaint Procedure
If you are dissatisfied with our services or products, you have the right to submit a complaint. Complaints may be submitted by e-mail, contact form, telephone or in writing. Complaints may be submitted free of charge and do not affect your general right to pursue claims before a court.
To speed up the complaint-handling process, it is recommended that you include your personal details, such as your name, address, e-mail address and contact telephone number, as well as the order number, information about the place of purchase and the grounds for the complaint. Complaints concerning product defects should include photographs of the relevant defects where possible.
We will respond to your complaint within 30 days using a durable medium, either in writing or electronically. If we do not respond within 30 days, the complaint will be deemed accepted.
Information on Alternative Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
The European Commission provides an online dispute resolution platform for online agreements. The platform is available at: http://ec.europa.eu/consumers/odr.
Updating the Terms and Conditions
(1) The provisions of these Terms and Conditions may be amended by us at any time.
(2) Amendments to the Terms and Conditions shall form part of agreements concluded with Customers on the effective date of such amendments if the Customer agrees to the amended Terms and Conditions when entering into the agreement or where such an option is available.
